Terms of Service

Welcome to Pexafy. By accessing or using the Pexafy image search API and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By registering for or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply to all users, including those who simply browse the site without creating an account.

2. Description of Service

Pexafy is a meta-search engine and API service that aggregates search results for images from third-party platforms (Unsplash, Pexels, Pixabay, Wikimedia Commons, Openverse, and others). Pexafy does not sell, host, or transfer ownership of images. We provide a unified API to discover and locate images across multiple sources.

The Service includes:

  • Text-based and image-to-image semantic search powered by neural AI
  • API access with rate limits based on subscription plan
  • Developer dashboard, API key management, and usage analytics

3. Account Registration & Security

To access the API, you must register and provide accurate information. You are responsible for:

  • Maintaining the confidentiality of your API keys and login credentials
  • All activities that occur under your account
  • Notifying us immediately at [email protected] if you suspect unauthorized access

You must be at least 16 years old to use the Service.

4. API Usage & Rate Limits

API usage is subject to the limits of your subscription plan (requests per month, rate per minute). Exceeding limits may result in request blocking. You may not:

  • Share API keys between multiple users or organizations without an appropriate plan
  • Attempt to circumvent rate limiting through multiple accounts
  • Use the API in a manner that could degrade service for other users

5. Free Tier & Paid Plans

The Free tier provides 1K API requests per month at no charge. Paid plans (Pro, Business) provide higher limits and additional features as described on the Pricing page. Prices are listed in USD and do not include applicable taxes.

Subscriptions auto-renew monthly or yearly. You may cancel at any time from your dashboard. Upon cancellation, access continues until the end of the current billing period.

6. Acceptable Use Policy

You agree NOT to use the Service to:

  • Scrape, copy, or redistribute our search index or database
  • Resell raw API data to third parties as a competing search service
  • Cache API responses beyond a reasonable period (max 24 hours for search results)
  • Violate any applicable laws, including intellectual property laws
  • Transmit spam, malicious code, or content that infringes third-party rights
  • Reverse engineer or attempt to extract our AI models or vector encodings

7. Image Licensing

Pexafy does not own or control the images returned by the API. Images remain the intellectual property of their respective creators and are subject to the license terms of the originating platform (Unsplash License, Pexels License, Pixabay License, Creative Commons, etc.).

You are solely responsible for verifying and complying with the applicable license before using any image. Pexafy provides license metadata (type, source URL) in API responses to help you identify usage rights.

8. Intellectual Property

The Pexafy name, logo, API design, AI models, and website content are owned by Pexafy and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PEXAFY DOES NOT GUARANTEE SEARCH RESULT ACCURACY, AVAILABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEXAFY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS.

10. Termination

We may suspend or terminate your account if you violate these Terms, without refund. You may delete your account at any time from Dashboard → Settings. On deletion, your data is removed per our Privacy Policy.

11. Changes to Terms

We may update these Terms at any time. We will notify you by email or via an in-app notice. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of France. Disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
